Terms of Service

Each order you place is a legally enforceable contract. If you fail to properly store and care for your produce, or if you fail to pick-up a farm order, you are still obligated to pay for the items you order.

We will inspect and pack all orders prior to distribution. In the event that product gets damaged during packing, we will provide a replacement or store credit to the customer, pursuant to our Refund Policy.

DEFINITIONS:

As used herein, the words “we,” “our,” and “Tucker Farms” mean Tucker Farms, Inc, and the words “you” and “your” mean our customers, potential customers, and any other individuals or entities that use this website.

WHOLESALE ORDERS:

We are always interested in new wholesale opportunities. If you represent a restaurant, caterer, grocery store, other institution, or broker, please click the Sign Up button above and submit your information so that we can connect with you to discuss your unique needs and account documentation.  

ORDERING DEADLINE:

To ensure delivery or pick-up, your order must be placed within the window designated for your account period.  The site will not allow online orders after your ordering window has closed.  

LATE ORDERS:

If you wish to place an order after your ordering deadline, email sales@tuckerfarmsga.com to check availability.  We understand that life sometimes gets chaotic, and we will always do our best to accommodate reasonable late orders, but please do not abuse this allowance.  We have implemented ordering deadlines to protect our family time, and to allow our amazing employees a predictable schedule, and we reserve the right to refuse any request for a late order for any reason.  

MODIFICATIONS & CANCELLATIONS:

If you need to modify or cancel your order, please send us an email at sales@tuckerfarmsga.com, and we’ll do our best to accommodate your request.  Many factors affect our ability to modify and cancel orders (especially on short notice), so please be aware that you do not have a “right” to modify or cancel your order.  We expressly reserve the right to refuse to modify or cancel any order for any reason.

REFUNDS:

Our business depends on maintaining happy and satisfied customers.  If you are dissatisfied with your purchase for any reason, we will do our best to make it right.  However, except in very special circumstances, we do not issue refunds.  We expressly reserve the right to refuse to issue a refund. Please see our Refund Policy for further information.

PAYMENTS:

Payment is due upon order completion.  We require e-check or credit card payments for most orders.  

Unless you are a wholesale customer who pays by check "on delivery" or otherwise pays on alternate terms we have agreed upon in writing, we will require authorization to process an ACH/e-check or credit card payment on or before your delivery day.  Your payment will not be charged immediately upon order completion but will be charged after we have finished harvesting, packing, and weighing your order (usually the evening before your delivery, sometimes on delivery day).

For community farm pick-up orders, your electronic payment (e-check or credit card) will be processed before your pick-up time and after we have packed your order.  If you wish to purchase additonal items in-person at the farm, please bring cash.

By storing your credit card or checking account information on our site: You expressly authorize Tucker Farms, Inc., to charge your credit card or bank account starting from the day you input your payment information and continuing periodically for each purchase you make from us. You understand and agree that Tucker Farms will charge your credit card, or initiate a withdrawal from your bank account, on on or before your delivery or pick-up day for each order you place. This applies to orders placed via this website or for orders you initiate by email, text, or on the phone.  This payment authorization will remain valid and in effect unless you, the customer, notify Tucker Farms in writing of your intent to cancel this agreement.

You are responsible for updating your payment information if any changes are made to your payment account(s).  You are responsible for keeping your password secure and overseeing who has access to your account.  You are responsible for ensuring that the individuals who have access to your account are authorized to place orders and create a contract on behalf of your and/or your organization. You will be responsible for all payments made through your account.

You will be responsible for a thirty-five ($35) fee for any returned checks, chargebacks, NSF, or any other returned payments, and you expressly authorize us to charge your payment method on file for any and all bank fees, late fees, and other costs and expenses incurred by us in relation to a returned payment against your account.

OUR PRODUCTS:

We strive to provide all of our customers with the freshest and most delicious produce possible.  Unless noted otherwise, all of the products sold on this website are products that we grew at Tucker Farms.  We attempt to only use pictures of products that we’ve taken with our own camera at the farm.  It is always our goal that pictures on this website, as well as the product descriptions, accurately describe our products.  However, we aren’t perfect, and each individual vegetable we pick is unique, so we can’t guarantee that the products you purchase will look or taste exactly as depicted on this website.

All of our products are sold and delivered “Ready to Wash” – this means that, even if your vegetables look clean, you should wash them before you eat them or serve them to other people.

We grow using sustainable methods and do not use any synthetic, chemical-based pesticides.  As such, you may find bug bites (or even live bugs!) on your product from time-to-time.  By ordering from us, you expressly agree that you understand our growing practices.

In order to maintain the freshness and quality of your vegetable purchase, you should refrigerate it as soon as possible after we deliver it.  (Except tomatoes; those are best left at room temperature).  We cannot guarantee the quality or appearance of vegetables that “sit out” at room temperature for several hours after delivery or that remain in a hot vehicle for any period of time.

We cannot guarantee that orders left at a public or private drop off location will be properly refrigerated; we recommend that you communicate directly with the individual(s) overseeing your drop off location about this.

If you have any questions about proper washing or storage of your purchase, please ask us.

PRICING:

Our prices may change from week-to-week.  And, if you shop in our on-line store and then see us at a market, you may notice that our prices are different.  Many factors affect our prices including, but not limited to, fluctuations in market prices, a product surplus, a product shortage, seed and labor costs, and how far we drive to a market.  Also, you may think that our prices have “gone up” when, in fact, a promotion ended.  (We offer frequent promotional pricing, but we cannot afford to discount every product every week). 

In short, we reserve the right to change our prices at any time; however, once you have completed an order, the price you paid will not change.  We attempt to be transparent about our pricing decisions, so, if you notice a price change and want to know the reasoning behind it, just ask.

INFORMATION ABOUT DELIVERY LOCATIONS:

We deliver directly to most of our restaurants and other wholesale customers in the Atlanta, Rome, and North Georgia area.  Depending on your location, you will be subject to an order minimum and assessed a per-order delivery fee.  

We also offer farm pick-ups on a limited basis.  We plan to expand our farm pick-up options over the next year and also may expand to offer "CSA-style" deliveries to homes or businesses within our delivery area.  

If you do not pick up your order from the farm or from a designated pick-up location within a reasonable and timely fashion, the business owner overseeing your delivery location may donate or dispose of your order as he or she deems appropriate.  This policy applies to both public and private drop off locations.

Additions, Modifications, & Discontinuations

Tucker Farms, in its discretion, may discontinue any product or any delivery location at any time.  To the extent possible, Tucker Farms will fulfill any orders that are outstanding at the time of any such discontinuance.

From time-to-time, the days and/or times of deliveries may change.  When practicable, all such changes will be noted on the website the week prior to such change(s).

We will always consider adding a new delivery location to our schedule.  If you believe your business (or neighborhood) would make an excellent delivery location, please contact us.
